So, in the situation where a person partakes in a controlled burning that complies with all the rules in place (such as authorization, no negligence, and required expertise) and accidental damage to a property occurs, this person will not be held liable.
This bill would only permit the California Native American tribes to have approval. Furthermore, local air districts will create agreements with the tribes to support them when burning within their land. The Senate bill’s focal point revolves around Native American tribes’ right to sovereignty. The act of recognizing this is a step in the right direction, as it helps both the Native communities and the environment. As an extension to this, the Natural Resource Agency and other government-affiliated agencies can cooperate with Native American tribes to remove or enact certain regulations. “ highlights:
